HARLO SurveySuite Terms of Service

Please read these Terms of Service carefully before using HARLO SurveySuite. By downloading, installing, or using the application, you confirm that you have read, understood, and agree to be bound by these terms. If you do not agree, do not use the application.
HARLO SurveySuite is a professional mobile application developed and operated by HARLO Industries LLC, a veteran-owned Service-Disabled Veteran-Owned Small Business (SDVOSB) based in Sacramento, California. The application provides land surveying calculation tools, coordinate geometry (COGO) utilities, exam preparation content for aspiring Licensed Surveyors, and related educational resources.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and HARLO Industries LLC ("HARLO," "we," "us," or "our") governing your access to and use of the HARLO SurveySuite mobile application, related software, content, and services (collectively, the "Service").
These Terms apply to all versions of the application, including the iOS and Android platforms, and to all subscription tiers including Student, Technician, Professional, Team, and Enterprise plans.
You must be at least 13 years of age to use HARLO SurveySuite. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under the age of 13. If we become aware that a user under 13 has registered, we will promptly deactivate that account.
Certain features of the Service require you to register for an account. When you create an account, you agree to:
• Provide accurate, current, and complete registration information;
• Maintain the security of your password and accept all risks of unauthorized account access;
• Promptly update your account information if it changes;
• Notify us immediately at legal@harlo.industries if you suspect unauthorized use of your account.
You are responsible for all activity that occurs under your account, whether or not you authorized it. HARLO reserves the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.
Your HARLO SurveySuite account is personal to you and may not be shared with others outside the parameters of your subscription tier. Team and Enterprise subscriptions define the number of permitted concurrent users. Sharing login credentials beyond your permitted user count, or providing access to third parties for commercial gain, constitutes a material breach of these Terms and may result in immediate account termination without refund.
HARLO SurveySuite is offered on a subscription basis. Current plan tiers include Student, Technician, Professional, Team, and Enterprise, each with different features, pricing, and user limits as described in the application and on our website. We reserve the right to modify plan features and pricing with reasonable advance notice to existing subscribers.
Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan) through the Apple App Store or Google Play Store, or directly through our payment processor. By subscribing, you authorize HARLO or its designated payment processor to charge the applicable subscription fee to your payment method on a recurring basis until you cancel.
All fees are stated in U.S. dollars and are exclusive of applicable taxes, which you are responsible for paying. Prices are subject to change. We will provide at least 30 days' notice of any price increase to active subscribers, and the new price will take effect at your next renewal cycle.
We may offer free trial periods at our discretion. Unless you cancel before the end of the trial period, your account will automatically convert to a paid subscription and you will be charged the applicable fee. Trial eligibility is limited to new accounts and may not be combined with other promotional offers.
You may cancel your subscription at any time through your account settings within the application or through the applicable app store. Cancellation takes effect at the end of your current billing period. You will retain access to the Service through the end of the paid period. HARLO does not provide prorated refunds for partial subscription periods, except as required by applicable law or as expressly stated herein.
All subscription fees are generally non-refundable. Refunds may be issued at our sole discretion in cases of demonstrable billing errors or technical failures that prevented access to the Service. Refund requests must be submitted within 14 days of the charge to legal@harlo.industries with a description of the issue. Refunds processed through the Apple App Store or Google Play Store are subject to the respective platform's refund policies, which may differ from ours.
Enterprise and institutional license agreements are governed by a separate written agreement executed between HARLO Industries LLC and the subscribing organization. In the event of conflict between these Terms and a valid enterprise agreement, the enterprise agreement controls.

THE COGO CALCULATORS, TRAVERSE TOOLS, COORDINATE GEOMETRY FUNCTIONS, AND ALL OTHER CALCULATION FEATURES PROVIDED IN HARLO SURVEYSUITE ARE MATHEMATICAL TOOLS INTENDED TO ASSIST QUALIFIED PROFESSIONALS. THEY DO NOT CONSTITUTE PROFESSIONAL SURVEYING SERVICES AND ARE NOT A SUBSTITUTE FOR THE INDEPENDENT PROFESSIONAL JUDGMENT OF A LICENSED LAND SURVEYOR. |
The computation features of HARLO SurveySuite — including but not limited to multi-leg traverse calculations, inverse calculations, bearing and azimuth conversions, area by coordinates, horizontal and vertical curve solutions, grid-to-ground factor applications, and triangle solutions — are mathematical utilities designed to perform calculations based on inputs you provide. The accuracy of any output depends entirely on the accuracy and completeness of the data you enter.
While we strive to ensure that our calculation algorithms are mathematically correct, HARLO makes no warranty that the results of any calculation are accurate, complete, or suitable for any particular professional application, project, or purpose. Rounding, projection, datum, and unit assumptions embedded in the software may produce results that differ from field conditions or from calculations performed under different methodological assumptions.
Before relying on any calculation output in a professional context, all results must be independently verified by a Licensed Professional Land Surveyor or other qualified professional with appropriate credentials, insurance, and legal authority in the jurisdiction where the work is performed.
Land surveying is a licensed profession governed by state-specific laws and regulations. The use of any calculation tool, including HARLO SurveySuite, does not authorize any person to practice land surveying without a valid license in the applicable jurisdiction. Users are solely responsible for ensuring their use of the application complies with all applicable professional licensing laws, statutes, and regulations.
HARLO SurveySuite includes an artificial intelligence-powered calculation assistant ("AI COGO Assistant"). Outputs generated by the AI COGO Assistant are suggestions based on pattern recognition and probabilistic modeling. They are not guaranteed to be correct, complete, or appropriate for any specific professional application. The AI COGO Assistant does not replace professional surveying judgment and should never be used as the sole basis for any decision with legal, safety, or financial implications.
AI-generated outputs may contain errors, omissions, or results based on misinterpreted inputs. HARLO expressly disclaims all liability for any loss, claim, or damage arising from reliance on AI-generated calculation results without independent professional verification.

The exam preparation features of HARLO SurveySuite — including practice questions, study plans, flashcards, and AI-generated question sets — are designed to supplement your independent study for professional licensing examinations, including but not limited to the Fundamentals of Surveying (FS) exam and the Professional Surveying (PS) exam administered by the National Council of Examiners for Engineering and Surveying (NCEES).
HARLO Industries LLC is not affiliated with, endorsed by, or in any way connected to NCEES, any state licensing board, or any other professional examination authority. The use of HARLO SurveySuite does not confer any credit toward professional licensure, continuing education requirements, or professional development hours unless separately and explicitly stated in a written agreement with the applicable licensing authority.
We make reasonable efforts to ensure that exam preparation content reflects current examination standards and surveying principles. However, examination content and reference standards change over time, and we cannot guarantee that all practice content is current, comprehensive, or reflective of actual examination questions. Users are responsible for verifying the currency of applicable reference standards (including current editions of the relevant surveying references) independently.
Some practice questions within HARLO SurveySuite are generated or adapted using artificial intelligence. While these questions are reviewed for quality, AI-generated content may contain errors, imprecise phrasing, or solutions based on assumptions that differ from official examination standards. AI-generated questions are intended for practice and concept reinforcement only, not as authoritative representations of actual examination content.
All content within HARLO SurveySuite — including but not limited to the application software, user interface design, calculation algorithms, practice questions, study materials, written content, graphics, logos, icons, and the HARLO SurveySuite name — is the exclusive intellectual property of HARLO Industries LLC or its licensors and is protected by applicable copyright, trademark, trade secret, and other intellectual property laws.
Nothing in these Terms grants you any ownership interest in our content. Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
You may not, without our prior written consent:
• Copy, reproduce, distribute, or create derivative works from any content within the Service;
• Reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the application;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use any content from the Service in any commercial product, service, or publication;
• Scrape, crawl, or systematically extract data from the Service by automated means;
• Use the application or its content to train, develop, or improve any competing artificial intelligence or machine learning system.
If you submit feedback, suggestions, bug reports, or other content to HARLO through the application or by email, you grant HARLO a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, and incorporate that feedback into our products and services without any obligation of compensation or attribution to you.
You agree to use HARLO SurveySuite only for lawful purposes and in a manner consistent with these Terms and all applicable laws and regulations. You agree not to:
• Use the Service to engage in any fraudulent, deceptive, or misleading conduct;
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or systems connected to the Service;
• Introduce any virus, malware, or other harmful code into the application or its associated systems;
• Use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with other users' ability to access it;
• Misrepresent your identity or affiliation with any person or organization;
• Use the application for any purpose that violates the professional standards or ethical codes governing the practice of land surveying or any other licensed profession;
• Reproduce, publicly display, or distribute any portion of the application's examination preparation content in any competing product, website, or service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HARLO EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
HARLO does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that any defects in the Service will be corrected, or that the results obtained from use of the Service will meet your requirements.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARLO INDUSTRIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR PROFESSIONAL STANDING — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL HARLO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO HARLO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.
HARLO EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY LOSS, CLAIM, PENALTY, FINE, PROFESSIONAL DISCIPLINE, PROPERTY DAMAGE, PERSONAL INJURY, OR OTHER HARM ARISING FROM: (A) RELIANCE ON ANY CALCULATION, COORDINATE, MEASUREMENT, OR OTHER OUTPUT GENERATED BY THE APPLICATION IN ANY PROFESSIONAL, LEGAL, OR REGULATORY CONTEXT WITHOUT INDEPENDENT PROFESSIONAL VERIFICATION; (B) ERRORS IN USER-PROVIDED INPUT DATA; OR (C) APPLICATION OF CALCULATION RESULTS TO FIELD CONDITIONS WITHOUT APPROPRIATE PROFESSIONAL VALIDATION.
Users who are licensed surveyors, survey technicians, or other professionals using HARLO SurveySuite in connection with professional work assume sole responsibility for the accuracy, appropriateness, and professional adequacy of all calculations and conclusions derived from the application.
You agree to defend, indemnify, and hold harmless HARLO Industries LLC and its officers, directors, employees, agents, licensors, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
• Your use of or access to the Service;
• Your violation of these Terms;
• Your violation of any third party's rights, including intellectual property, privacy, or professional licensing rights;
• Any professional work, project, decision, or deliverable in which you used or relied upon outputs from HARLO SurveySuite;
• Your violation of any applicable law or regulation.
HARLO reserves the right to assume exclusive control of the defense of any matter subject to indemnification, at your expense. You agree to cooperate fully with HARLO in the defense of any such claim.
HARLO SurveySuite integrates with third-party services to provide certain features. Your use of these integrated services is subject to the respective third party's terms and privacy policies, which are separate from and in addition to these Terms. HARLO is not responsible for the practices, content, or reliability of any third-party service.
Third-party services integrated with or accessible through HARLO SurveySuite may include:
• Apple App Store and Apple services (including in-app purchase processing and TestFlight);
• Google Play Store and Google services;
• Payment processing services (including Stripe);
• Anthropic AI services (powering the AI COGO Assistant feature);
• Analytics and crash reporting services.
Links to third-party websites or services from within the application do not constitute an endorsement of those sites or services by HARLO. We encourage you to review the terms and privacy policies of any third-party service you use in connection with HARLO SurveySuite.
You may stop using the Service at any time and may cancel your subscription as described in Section 3.4. Deleting the application from your device does not automatically cancel your subscription.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any of the following reasons:
• Breach of any provision of these Terms;
• Non-payment of subscription fees;
• Conduct that we determine, in our sole discretion, is harmful to other users, third parties, or the integrity of the Service;
• A legal requirement or court order requiring us to do so;
• Extended periods of account inactivity, with advance notice where practicable.
Upon termination, your right to use the Service immediately ceases. Provisions of these Terms that by their nature should survive termination — including but not limited to Sections 4, 5, 6, 8, 9, and 13 — will survive.
HARLO reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may update these Terms from time to time. When we make material changes, we will notify you by updating the effective date at the top of this document and, where appropriate, by sending notice to the email address associated with your account or by displaying a notice within the application. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes.
If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date of the changes.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Before initiating any formal legal proceeding, you agree to contact us at legal@harlo.industries and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice. If we cannot resolve the dispute informally, either party may pursue the remedies described below.
Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration will be conducted in Sacramento, California, or via remote hearing where mutually agreed. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You and HARLO each waive the right to a trial by jury and the right to participate in a class action lawsuit or class-wide arbitration. If the class action waiver in these Terms is found unenforceable, then the entirety of this arbitration provision shall be void.
For any claims not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Sacramento County, California.
These Terms, together with our Privacy Policy and any separate enterprise or institutional license agreement, constitute the entire agreement between you and HARLO regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
HARLO's failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. A waiver of any provision will only be effective if made in writing and signed by an authorized representative of HARLO.
You may not assign or transfer your rights or obligations under these Terms without HARLO's prior written consent. HARLO may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of substantially all of our assets.
HARLO will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, labor disputes, or failures of third-party infrastructure including telecommunications networks or app store platforms.
